This is separate from the Marketplace Terms and Independent Fixer Agreement. No report should be ordered until the Fixer separately authorizes this exact disclosure.
01 Disclosure
Fixerly Technologies LLC may obtain one or more consumer reports about a prospective or participating Fixer from a consumer reporting agency for purposes of evaluating eligibility or continued eligibility to participate on the Fixerly Platform.
02 Possible report information
A report may include legally permitted information concerning identity, criminal history, motor vehicle records where relevant, and other background information bearing on eligibility. The final scope depends on the screening product, purpose, law, and attorney-approved eligibility matrix.
03 Continuing reports
Where permitted by applicable law and the separate authorization, Fixerly may obtain additional consumer reports during participation to evaluate continued eligibility. Counsel and the screening provider must approve whether and how continuing authorization is used.
04 Separate authorization
The Fixer must separately authorize Fixerly Technologies LLC to obtain the reports described above. This standalone document must not include unrelated releases, indemnity, arbitration, Marketplace Terms acceptance, or Independent Fixer Agreement acceptance.
05 Evidence and vendor certification
Before ordering a covered report, Fixerly will preserve the disclosure version, signed authorization, server timestamp, delivery record, screening vendor, request identifier, and required state notices and will provide any certification required by the consumer reporting agency.
06 Potential adverse decisions
If report information may lead to a materially adverse eligibility decision, Fixerly will use an attorney-approved review process rather than an immediate automated denial. When required, it will provide pre-adverse notice, a copy of the relied-upon report, the current Summary of Rights, vendor and Fixerly contact information, and a reasonable opportunity to dispute or correct information.
07 Final adverse action
When required, a final adverse-action notice will identify the consumer reporting agency, explain that the agency did not make the decision, describe rights to dispute accuracy and obtain another copy, and provide any applicable appeal route.
08 Items awaiting approval
The screening vendor’s forms, state riders, permissible-purpose analysis for independent providers, report scope, ongoing-screening language, eligibility matrix, individualized-review standards, waiting period, appeal contact, retention, and Operations permissions require attorney and vendor approval.
