Fixerly provides the technology marketplace. Customers choose and hire independent Fixers directly. The exact job scope and price become a separate recorded Customer–Fixer Service Agreement.
01 Agreement and incorporated policies
These Terms are a binding agreement between you and Fixerly Technologies LLC. They apply to the Fixerly apps, website, communications, payment tools, artificial-intelligence features, operations tools, and related services. The Privacy Policy, Independent Fixer Agreement, Customer–Fixer Service Agreement, Payment, Refund and Cancellation Policy, Restricted Services Policy, Electronic Communications Terms, and other expressly identified policies are incorporated where applicable.
02 Fixerly is a technology marketplace
Fixerly enables Customers and independently operated individuals or businesses called Fixers to find one another, exchange information, communicate, document job terms, schedule work, facilitate payment, and preserve transaction records.
Fixerly does not itself perform the repair, construction, maintenance, installation, assembly, cleaning, moving, inspection, trade, professional, or other underlying services unless a separate signed writing expressly says otherwise. Fixerly is not the contractor performing a job, a staffing agency, or a Fixer’s employer merely because the Platform provides marketplace controls, records, payments, or support.
03 Direct Customer–Fixer contract
The Customer selects and hires the Fixer directly. A Fixer’s submitted quote is the offer of scope, labor, materials estimate, total price, and timing. The Customer’s selection accepts that offer and forms the recorded Customer–Fixer Service Agreement. Fixerly is not a party to that underlying services agreement merely because it is formed, documented, scheduled, or paid through the Platform.
04 Accounts and eligibility
Users must be at least 18, have legal capacity, provide truthful and current information, use their own lawful identity, protect login credentials, and promptly report suspected compromise. Fixerly may require identity, credential, business, tax, payment, safety, or eligibility information and may use qualified service providers for verification.
05 Independent Fixers and qualifications
Subject to law and legitimate marketplace eligibility rules, Fixers decide whether and when to use Fixerly, which opportunities to accept, and the manner and means of performing work. Fixers must accept only work they reasonably believe they can perform safely, competently, and lawfully and must maintain every required license, registration, permit, bond, insurance policy, tool, and qualification.
Badges, ratings, background-check indicators, credential indicators, and approval states show only that stated criteria were met at a relevant time. They are not guarantees of character, workmanship, timeliness, future licensing, insurance coverage, safety, or completion.
06 Alaska contractor requirements
For Alaska work, Fixers must comply with applicable contractor and professional requirements. A Fixer relying on handyman contractor registration may not accept a project over the legally applicable aggregate project limit, including labor, materials, and other project items. Related work may not be divided across jobs, invoices, accounts, or change orders to evade licensing, registration, bonding, insurance, or project-value requirements.
07 Quotes, changes, and materials
Users must review the job scope and price before accepting. Additional chargeable work requires a recorded Customer-approved change order before it begins, except reasonable emergency action needed to prevent imminent injury or significant property damage. Material purchases must be authorized, related to the job, and supported by records when required. Customer-supplied materials remain subject to compatibility, shortage, specification, and manufacturer-defect risks.
08 Payments and fees
Customers authorize approved payment providers to verify payment methods, place authorization holds, collect approved labor, materials, fees, taxes, cancellation charges, adjustments and tips, and issue refunds. Fixers authorize payout onboarding, disclosed deductions, reversals, reserves, chargebacks, tax reporting and lawful setoff. Users may not intentionally move a Platform-originated job off Platform to evade disclosed fees or protections.
09 Safety, emergencies, and restricted services
Fixerly may hard-block or escalate jobs based on category, value, location, credentials, hazards, legality, emergency indicators, or Operations review. Fixerly is not an emergency-response provider. Gas leaks, fire, carbon-monoxide danger, active flooding near electricity, structural collapse, medical emergencies, violence, or crime in progress should be directed to 911, the utility, or an appropriate emergency or licensed provider.
10 Content, records, and privacy
Users retain ownership of their content and grant Fixerly a limited license to host, process, reproduce, display, transmit, and analyze it as needed to operate, secure, document, enforce, and improve the Platform. Users must have authority to provide content. Fixerly may preserve messages, photographs, approvals, location and arrival events, receipts, screening and credential records, and other evidence for transaction, safety, fraud, dispute, insurance, tax, and legal purposes.
11 Artificial intelligence
AI-assisted descriptions, classifications, pricing guidance, summaries, safety flags, and other output are informational. They do not inspect a property, diagnose a condition, establish a professional standard, guarantee price, or replace the Fixer’s actual-site evaluation and professional judgment. Users must review and correct material information.
12 Prohibited conduct
Users may not impersonate others, misrepresent credentials, share or sell accounts, commit fraud, harass or discriminate, offer illegal or restricted services, manipulate reviews, misuse payment disputes, scrape or reverse engineer the Platform, interfere with security, misuse access information, pressure Customers into unauthorized work, or structure transactions to evade law.
13 Enforcement and deactivation
Fixerly may investigate, preserve evidence, restrict categories, pause transactions, remove content, or suspend or terminate access when reasonably necessary for safety, fraud, legal compliance, payment risk, material complaints, or policy enforcement. Non-waivable notice, appeal, classification, and procedural rights remain unaffected.
14 Disclaimers and limitations
The Platform is provided on an as-available basis to the maximum extent permitted by law. Fixerly does not guarantee that a Fixer will accept, arrive, complete work, achieve a particular result, or remain eligible, licensed, bonded, or insured. Nothing disclaims a warranty, duty, remedy, or liability that cannot lawfully be disclaimed.
The final liability cap, indemnity, arbitration administrator and rules, venue, opt-out process, fee allocation, arbitrability, and mass-arbitration procedure are intentionally reserved for attorney approval and are not part of this review draft.
15 Changes, electronic notice, and contact
Material changes requiring renewed consent will be published as a new immutable version and presented for explicit acceptance. Historic accepted versions will not be overwritten. Electronic notices and records are governed by the Electronic Communications Terms. Alaska law governs except where another law or a non-waivable rule applies.
